Presco Delivery

1.1 Portal — the website www.presco-delivery.com operated by Presco Delivery Ltd. and other related media channels or mobile applications collectively referred to as the "Site."

1.2 Platform — the Presco Delivery service selection platform accessible on the Site.

1.3 User — the client or entity who accesses or uses the Services available on the Site.

1.4 Carriers — Presco Delivery's partner companies whose delivery services are made available to the User on the Site.

1.5 Presco Delivery — Presco Delivery Ltd., the owner and operator of the Site, registered under [Insert Legal Entity Information] in [Insert Jurisdiction].

1.6 Terms — these Terms & Conditions of Use, constituting a legally binding agreement between you and Presco Delivery, governing your use of the Site and Services.

1.7 Service — specific delivery and logistics services selected by the User on the Platform after entering order details, including additional options and custom features.

1.8 Privacy Policy — the Privacy Policy published on the Site, governing the collection and use of personal data.

1.9 Order — a confirmed request by the User for a specific Service offered on the Site.

1.10 Shipment — any parcel, package, or item to be delivered as part of a User's Order.

1.11 Recipient — the person or entity designated by the User to receive the Shipment.

1.12 Sender — the person or entity initiating the Shipment and specified on the Shipment Consignment Note.

1.13 Shipment Consignment Note — a label or information sheet containing essential details for the delivery of the Shipment, including the Recipient's address and any specific handling instructions, which the User must attach to the Shipment.

1.14 Pick-Up Point — a designated location (e.g., retail store, gas station) where the Carrier can deliver a Shipment, and from which the Recipient may collect it.

1.15 Parcel Terminal — a secure locker or storage unit used by Carriers for holding a Shipment until it is picked up by the Recipient within a specified timeframe.

1.16 Additional Services — items or substances forbidden for shipment per Carrier guidelines or local regulations, as detailed in the Site's Terms or Carrier's Additional Information.

1.18 Additional Invoice — an invoice issued by Presco Delivery to cover any penalties, non-compliance fees, or additional expenses incurred due to a User's breach of these Terms or Carrier requirements.

2.1 Purpose of the Site — The Site allows Users to compare various delivery services provided by our partner Carriers and select and order the service that best fits their needs. Delivery services available on the Site are offered through our partner Carriers, listed under the "Our Partners" section.

2.2 Role of Presco Delivery — Presco Delivery operates the Site as an intermediary platform, providing Users with access to delivery services executed by Carriers. Presco Delivery facilitates the selection, ordering, and tracking of these services but does not provide delivery services directly.

2.3 Data Protection — The principles governing the processing of Users' personal data on the Site are outlined in the Privacy Policy, which is accessible on the Site.

2.4 User Responsibility — Before using the Site, Users are required to read and understand these Terms, the Privacy Policy, and any Additional Information related to specific Carriers. Users must confirm their agreement to these documents by selecting the checkbox labeled "I confirm that I have read and agree to the Presco Delivery Terms, Privacy Policy, and Carrier Additional Information" before placing an order. By doing so, the User confirms their acceptance of the Terms, Privacy Policy, and Additional Information. If a User does not agree with these documents, they are not permitted to use the Site.

2.5 Binding Terms — The Terms, Privacy Policy, Additional Information, FAQ, and any other conditions published on the Site are binding on all Users and collectively form the terms of a distance contract.

2.6 Modifications to Terms — Presco Delivery reserves the right to amend these Terms and Privacy Policy at any time by posting updated versions on the Site. The User's confirmation in accordance with Clause 2.4 applies to the latest version of the Terms and Privacy Policy as of the time the Order is placed. Carriers may also update their Additional Information at any time, and Users are expected to review the latest Carrier information before placing each Order.

2.7 Frequently Asked Questions (FAQ) — The FAQ section on the Site provides information directly applicable to accessing and using the Services and completing Orders. Users are required to comply with all applicable Terms, including the obligations specified in Clauses 2.4 and 2.5, when referring to the FAQ.

You may use the Applications in accordance with our contractual arrangement with you and /or as per these Terms. You must be over the age of eighteen (18) years and able to understand and agree to the terms, conditions, obligations, representations, and warranties set forth in these Terms.

3.1. The User is not obliged to register on the Portal in order to receive the Services offered on the Portal. The User has the right to register on the Portal by filling in the input fields of the registration form, presenting his/her personal data and agreeing to the transfer of personal data.

3.2. For registered Users, a profile is created on the Portal and a user number is assigned after the User's registration is completed in accordance with the Terms. Registered Users of the portal are provided with the preservation of Order History and User data throughout the registration period.

3.3. The User has the right to manually delete the User profile created on the Portal and the personal data stored in it at any time. The User has the right to manually make changes to the data entered in his profile.

3.4. The User has the right to use the Portal Services. The User has the right to compare the Services offered by the Carriers and receive a list of delivery offers free of charge. The User shall make payments in the cases set out in these Terms or Additional Information.

3.5. The User of the Portal is prohibited to use the Portal for such unintended purposes, including entering unsolicited information in the input fields.

3.6. The User is responsible for the fulfilment of the obligations of the Sender and the Recipient specified in the Terms in relation to the Orders made by the User.

4.1. On the Platform the User can receive Offers for shipping a specific User’s Shipment. To select and receive Carrier offers, the User uses the Platform’s tool – "Platform Calculator".

4.2. On the "Platform Calculator" the User enters the requested basic information in the relevant fields about the specific Shipment: country, city and postal code for the delivery address, the size and type of the Shipment.

4.3. According to Clause 4.2 of the Terms, after entering and confirming the data specified, all Carriers' offers for the specific Order are displayed on the Platform, indicating the price of the Order, possible Shipment’s receipt time and the possible delivery time by each Carrier, separately indicating available delivery methods (express delivery, expedited delivery, regular delivery, etc.).

4.4. For each price offer presented, the User is provided with Additional Information on the conditions of the specific Carrier as well as Additional Services in relation to the delivery. The User gets acquainted with the Additional Information independently by opening the sections "Additional Services" and "Additional Information", as well as by visiting the website of the specific Carrier to get acquainted with the specific conditions.

4.5. The User completes the Order by selecting one of the offers provided by the Carriers presented on the Platform for the specific Order. The Carrier is selected by clicking on the relevant section named "Order". By selecting and confirming the specific price offer, the User agrees to the delivery terms of the Carrier, including the "Additional Information" corresponding to the Clause 4.4 of the Terms.

4.6. When placing an Order the User fills in the Order form generated on the Platform and indicates the requested information about the specific Order, including Sender, Recipient, pickup address of the Shipment, its delivery address, type of Shipment, describes the content of the Shipment, its value, size and weight in the specified range, required date of pickup and delivery of the Shipment, as well as the special characteristics of the Shipment in accordance with the Clause 6.2 of the Terms, and other information that is required.

4.7. The User is responsible for the accuracy and truthfulness when providing information that is stated in Clause 4.6. and assumes full responsibility for damage to the Shipment, the Carrier's refusal to deliver, other delivery disruptions, as well as additional costs calculated by the Carrier in case the information provided by the User was incorrect.

4.8. When placing an Order the User is obliged to indicate the value of the Shipment. The value of the Shipment must be justified and true. In case of a dispute, the User must provide documents to justify the value of the Shipment, e.g., a receipt.

4.9. The User independently prepares and delivers the Shipment to the courier of the selected Carrier, based on Section 6 of these Terms.

4.10. The User's Order is transferred to the selected Carrier within 3 (three) business days after receiving the full prepayment in the Presco Delivery bank account. In case the User's Order is subject to post-payment, the Order is transferred to the Carrier immediately after the completion of the Order’s placement in accordance with Clause 4.5 and 4.6 of the Terms.

5.1 Order Payment — The User is required to pay for each Order in accordance with the pricing specified in the chosen service offer. The fee calculation takes into account the details entered by the User, such as weight, dimensions, and quantity of Shipments. The total Order fee, inclusive of any applicable taxes, is calculated and displayed during the order process.

5.2 Payment Methods — When placing an Order, the User may select from the following payment options:

5.2.1 Payment by Card — Users may pay on the Site by entering their payment card details. If using a card not registered to the User, the User confirms they have the right to use that card and accepts full responsibility for doing so.

5.2.2 Internet Banking — Users may select a bank from those available on the Site, log in to their online banking, and confirm the payment automatically generated for the Order.

5.2.3 Pre-Payment Invoice — Upon completing an Order, Presco Delivery will email an invoice to the User, based on the selected price offer. The User must pay this invoice within 5 (five) days from the date it was issued, or by an earlier deadline if specified. The payment term may be shorter based on the delivery timeline specified in the User's Order.

5.3 Post-Payment Option — For Users with an active service contract with Presco Delivery that allows post-payment, this option is available in addition to the methods in Clause 5.2. Post-payment is processed in accordance with the terms outlined in the respective service agreement.

5.4 Order Confirmation — After payment is received as specified in Clause 5.1, Presco Delivery will email a confirmation of payment to the User, attaching a Shipment Consignment Note. Receipt of the consignment note serves as acknowledgment of Order acceptance by Presco Delivery, finalizing the contract between the User and Presco Delivery.

5.5 Non-Refundable Payment — By completing the payment per Clause 5.2, the User confirms acceptance of the Order terms. If the Order cannot be fulfilled due to User-related issues (e.g., unilateral cancellation by the User or Carrier refusal due to non-compliance of the Shipment), the User is not entitled to a refund.

5.6 Shipment Verification — Shipments are weighed and measured by the Carrier before delivery. Carrier-determined measurements are final. If a Shipment exceeds the weight or size specified in the Order, Presco Delivery reserves the right to:

5.6.1 Refuse — to complete the Order if the Carrier rejects the Shipment, or

5.6.2 Charge the User — a surcharge for the discrepancy, based on the Carrier's price list. The final Order cost is adjusted according to the Carrier's assessed dimensions and weight.

5.7 Additional Expenses — The User is liable for any extra costs incurred by Presco Delivery or the Carrier due to User violations of these Terms, including costs related to additional actions taken by the Carrier to fulfill the Order as per the Carrier's price list.

5.8 Issuing Additional Invoices — Presco Delivery may issue an Additional Invoice for such costs within 6 (six) months of incurring the additional expenses. The User will receive this invoice via email.

5.9 Additional Invoice Payment — The User is required to pay any Additional Invoice within the specified timeframe. Failure to pay may result in suspension of further Order processing and restriction of access to the User's account until payment is received.

6.1. When placing an Order, the User is obliged to disclose the content of the Shipment by filling in the relevant field in the Order form in accordance with Clause 4.6 of the Terms. Dangerous contents must be declared.

6.2. When filling in the Order form, the User must mark special features of the Shipment, such as "Fragile", "Bulky", or "Delivery in a shopping centre".

6.3. The User is fully responsible for the content of the Shipment delivered to the Carrier.

6.4. It is prohibited to include in the Shipment articles prohibited by Latvian law, EU regulations, or those of the transit or destination country.

6.4.1. Narcotic or psychotropic substances.

6.4.2. Pornographic or erotic material involving children, animals, necrophilia, or violence.

6.4.3. Articles or substances prohibited in destination countries.

6.4.4. Articles or substances prohibited for export or circulation in Latvia.

6.4.5. Items that may contaminate or damage other postal items or equipment.

6.4.6. Postcards or letters resembling private correspondence between others.

6.4.7. Explosive, flammable, radioactive, biological, or infectious substances.

6.4.8. Money, coins, banknotes, and securities.

6.4.9. Items prohibited under medicine or transport regulations.

6.4.10. Animals.

6.5. If prohibited items are found, the Carrier may refuse or terminate the Order. The User must cover storage and return costs.

6.6. No refund is provided for Orders cancelled due to prohibited contents.

6.7. Penalties: EUR 130 per Shipment with prohibited contents. Payable within 3 business days after invoicing.

6.8. The User is responsible for properly packaging the Shipment according to FAQ and Carrier guidelines.

6.9. Carriers may refuse poorly packaged Shipments or those lacking required labels or information.

6.10. The User must ensure the Shipment is delivered to the Carrier at an accessible location and at the specified time.

6.11. Shipment content and packaging must not damage other items or Carrier property/personnel.

6.12. The User is liable for any losses caused by non-compliance, including Carrier downtime and false calls.

7.1. Delivery of the User's Shipment is ensured in accordance with the Order, observing the delivery conditions of the particular Carrier. The Carrier shall choose the method of storage, transportation, loading, unloading and storage of the Shipment, taking into account the special features of the Shipment indicated on the packaging of the Shipment.

7.2. If the Recipient refuses to accept the Shipment and/or upon the request of the Carrier's courier to present an identity document or sign for the receipt of the Shipment, the Shipment shall not be issued to the Recipient and shall be returned to the Carrier's warehouse. In the case specified in this Clause, the Carrier shall handle the Shipment in accordance with its Special Conditions.

7.3. If the delivery address specified by the User cannot be found, the Recipient cannot be found and cannot be called or in the case specified in Clause 7.2 of the Terms, the Carrier shall handle the Shipment in accordance with its Special Conditions. For re-delivery of the Shipment, change of delivery address, return to the Sender or storage, the Carrier is entitled to apply an additional payment in accordance with the conditions of the particular Carrier, for which Presco Delivery issues the relevant Additional Invoice to the User. In case the Sender refuses to accept the Shipment back or cannot be reached, the Shipment is destroyed.

7.4. The Carrier shall be responsible for the preservation of the Shipment from the moment the Carrier's courier has accepted the Shipment until the moment when the Shipment is delivered to the Recipient or returned to the Sender. The moment of delivery of the shipment is fixed in accordance with the regulations of the particular Carrier.

7.5. Unless otherwise specified in the Carrier's Additional Information, the Order shall be deemed fulfilled (Shipment – delivered) at the moment when the Shipment is delivered to the specified delivery address, pick-up point, placed at the Parcel terminal, delivered to the post office, delivered to the Recipient's neighbour, left at the delivery address or placed in the mailbox, for which the Carrier 's courier leaves a remark in the delivery documents. The User ensures that the Recipient takes the Shipment at the pick-up point or at the Parcel terminal, observing the deadlines set by the Carrier.

7.6. The User is obliged to ensure that the person who is at the specified time and place of delivery of the Shipment is the Recipient indicated on the Shipment or the person who is entitled to accept the Shipment on behalf of the Recipient. The Carrier is not obliged to verify the Recipient's identity document, as well as is not obliged to obtain the Recipient's signature on receipt of the Shipment. However, at the request of the Carrier's courier, the Recipient is obliged to present an identity document, power of attorney and/or sign upon receipt of the Shipment.

7.7. The Carrier accepts and hands over the Shipment, checking only the number of items in the Shipment and the condition of the packaging. If the packaging is damaged during delivery, the Carrier's representative shall, at the request of the Recipient, inspect the damaged items of the Shipment together with the Recipient, opening them, drawing up a report and making appropriate notes in the Consignment Note on the detected damage, as well as photographing the damage.

7.8. The User takes responsibility for the fact that the Recipient accepts only Shipments addressed to him/her. In case the Recipient has unreasonably accepted a Shipment that is not addressed to him and does not belong to him, the User and the Recipient are obliged to immediately notify Presco Delivery and ensure the return of the unreasonably accepted Shipment to the Carrier at their own expense. If the User and the Recipient do not comply with the provisions of this clause, they may be held fully liable for damages caused Presco Delivery to, third parties and the Carrier, as well as the Sender, the Recipient and the User lose the right to make claims for incorrect delivery.

7.9. In the event that the Shipment is not delivered on time due to the fault of the Sender, the Recipient or the User, Presco Delivery and the Carrier shall not be liable for non-delivery of the Shipment on time.

7.10. The possible delivery time of the Shipment indicated in the Offers is of an informative nature, and Presco Delivery does not take responsibility for the delivery of the Shipment within the specified time, unless such responsibility has been directly assumed by the Carrier. In any case, Presco Delivery and the Carrier shall not be liable for the delivery of the Shipment within the specified time if the User has delayed the payment of the Invoice or delivery of the Shipment to the courier or if the Recipient has not been reached at the delivery address.

7.11. The User performs all the necessary actions regarding the fulfilment of regulatory enactments for the implementation of customs procedures, independently preparing all the necessary documentation, paying the related

7.12. By using the PrescoDelivery service, the user acknowledges and agrees that all rules regarding the submission of shipments, their transfer for delivery, receipt, return, compliance with delivery terms, as well as restrictions on contents, are governed exclusively by the terms and policies of the respective carrier and logistics partners. The PrescoDelivery service functions solely as a technological platform providing users with convenient access to the services of such partners and bears no responsibility for the quality, timing, completeness, or proper execution of obligations established by third-party organizations. The user is solely responsible for reviewing and complying with the current rules and restrictions of the partners prior to placing an order. By using the service, the user expressly agrees that all legal and factual relationships concerning transportation, returns, compensations, or any other actions related to the movement and handling of shipments shall arise directly between the user and the carrier partners, whose terms are mandatory and binding in full.

8.1. The User, Sender, and Recipient have the right to submit written claims to Presco Delivery for violations by the Carrier when executing an Order. All claims must be submitted exclusively through Presco Delivery. Direct contact with the Carrier excludes Presco Delivery's liability.

8.2. Claims regarding violations by Presco Delivery unrelated to Shipment delivery must be submitted in writing within 5 business days, including details specified in Clauses 8.7.1 and 8.7.2.

8.3. Claims for visible damage or delivery errors must be made at delivery time with documentation by both the Recipient and Carrier's courier, per Clause 6.7. If the courier refuses, a claim must be submitted to Presco Delivery within 1 calendar day.

8.4. Claims for hidden damage discovered after delivery must follow the specific deadlines below:

8.4.1. If the Carrier did not collect the Shipment, the claim must be submitted within 2 calendar days from the Shipment Order date.

8.4.2. Claims for damage during delivery must be filed within 2 business days after receiving the Shipment, per Clauses 6.4 and 6.5.

8.4.3. Claims for unattended or indirect deliveries (e.g., lockers or mailbox) must be submitted within 2 calendar days of retrieval.

8.5. All claims must be submitted by 17:00 Latvian time on the final day of the specified period. Claims not meeting this requirement may be rejected.

8.6. Claims must be submitted using the form in the "Terms" section of the Portal and sent to info@prescodelivery.eu with a secure e-signature or scanned signed document in PDF or JPG format.

8.7. Claims must include the following:

8.7.1. Claimant's full name, ID or legal entity registration number, contact info, and bank account details if requesting compensation.

8.7.2. Order details including Shipment number, shipment date, Recipient name, and declared value.

8.7.3. Incident description, claim nature, compensation amount, and substantiation.

8.7.4. A copy of the invoice or bill of lading, if applicable.

8.7.5. Photos showing visible Shipment damage.

8.7.6. Signed documentation by Carrier and, if possible, Sender or Recipient confirming damage or discrepancies.

8.8. Presco Delivery will review the claim and, if valid, forward it to the Carrier according to their timelines.

8.9. Presco Delivery may request further information or documents, especially at the Carrier's request.

8.10. A response will be provided within 40 days of claim receipt, after Carrier's review. Carrier may extend the review time if needed.

8.11. If the Carrier approves the claim, compensation is provided based on market value or loss, within Carrier's limits, and paid after funds are received.

8.12. No compensation is given for indirect or incidental damages, including lost profits or non-material losses.

8.13. Upon compensation, ownership of the Shipment transfers to the Carrier or insurer, if applicable.

8.14. Consumers may seek out-of-court dispute resolution where applicable. More information is available at http://www.ptac.gov.lv/lv/content/arpustiesas-pateretaju-stridu-risinataju-datubaze.

8.15. Legal disputes shall be resolved in the courts of the Republic of Latvia under Latvian law.

9.1. Neither party will be liable — for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes (which events and/or circumstances are hereinafter referred to as “Force Majeure”), to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic (including Covid-19), quarantine, civil commotion, breakdown of communication facilities, breakdown of web host, breakdown of internet service provider, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy.

9.2. For the avoidance of doubt — Force Majeure shall not include (a) financial distress nor the inability of either party to make a profit or avoid financial loss, (b) changes in the market prices or conditions or (c) a party’s financial inability to perform its obligations hereunder.

10.1. All property and non-property — rights of the author to the Service Platform and Portal provided on the Portal, as well as all information published on the Portal, including the Terms, FAQs and Privacy Policy, belong to SIA “DOOR TO DOOR”, registration number 43603088149.
